• The contest shall be live from 23rd January 2024 up to 30th January 2024. However, the contest period may be reduced/extended at the sole discretion of the Almond Board of California (“organizer”).
• The participant has to fulfil both the steps of the contest to be eligible for it i.e.:
o Participant has to share his/her unique almond story on the microsite, linked in the influencer’s post.
o Participant has to leave a comment with the hashtags #AlmondDiaries and #NationalAlmondDay on the respective influencer’s handle to confirm participation.
• Each participant can only submit one entry. Multiple entries are not allowed. Participants take full responsibility for the entries shared by them.
• The contest is open to residents of India aged 14 years of age and above. There is no entry fee to sign-up for the contest.
• The prize for the said contest is an exciting hamper of carefully curated almond-goodies. Prizes are non-transferable & organiser reserves the right to modify/withdraw the prizes, with/without any prior notice.
• Organiser will not be responsible and liable for acceptability, suitability, delivery, service, defects, deficiency, performance, or quality of the services /products/prize provided under the contest.
• The winners shall be announced and notified on the applicable social handle of the influencer on 31st January 2024.
• The theme of the contest and the applicable rules shall be subject to change at the sole discretion of the organizer. Such change shall be effective immediately upon posting to the microsite. Organiser reserves the right to withdraw the contest and/or change, amend, extend, and/or alter any of the terms & conditions of this contest, without any reason and at any time, without prior notice.
• Participant warrants that the entries as submitted are original works, and in no manner infringe on any third party’s intellectual or privacy rights. Organiser does not encourage and is not responsible for the misuse of any content. Copyrighted, obscene, provocative or otherwise questionable content will not be considered. Organiser retains sole discretion as to what constitutes inappropriate content.
• Incomplete information provided or failure to provide true and accurate information, failure to submit proof of identification and/or original confirmation number will automatically disqualify a participant. Organiser shall have the absolute and sole discretion to determine whether any participant should be disqualified by reason of failure to abide by these terms and conditions, bad faith, fraud or any other legitimate reason.
• Participant keeps the organizer and any of their respective aren’t companies, subsidiaries, affiliates, divisions, officers, employees and agencies fully indemnified against (i) any liability whatsoever, and waive any and all causes of action, related to any liability, claims, costs, injuries, losses, or damages of any kind arising out of or in connection with this contest or (ii) any third-party action or claim arising out of infringement of any such third-party intellectual or privacy rights.
• The participant(s) hereby give express permission to organiser & its affiliates to freely use and distribute in any manner and through any medium their submissions and content thereof as entered by them in this contest.
• The influencer/organizer reserves its right to select the winners from all the eligible entries received as per the internal selection process.
• Such declaration of winner by the influencer shall be final and all the participants including entrants & winners hereby waives any and all rights to object or question such decision of the organizer. Prizes are offered on 'NO EXCHANGE, NO REFUND' basis.
• All participants including entrants and winners will not have any claim against organiser or its affiliates with regard to matters connected with this contest. All participants including entrants and winners expressly waive any and all rights of claim against organiser with regard to the contest, prize, declaration of the winner or the T&Cs hereof. Further, organiser shall not be liable for any losses, damages, taxes, liabilities or inconvenience suffered by any participant as a result of these terms and conditions, entering into this contest, or accepting any part of the prize.
• Materials/content sent/submitted with organiser or influencer and other communications of any kind as well as submission of an entry to this contest shall be deemed to be non-confidential. Organiser shall be free to reproduce, distribute and publicly display such feedback, and materials without limitation or obligation of any kind. Organiser is also free to use any ideas, concepts, know-how, or techniques contained in such submissions or materials for any purpose. Participants agree and confirm that such submissions and any content/material included therein do not breach the intellectual and/or proprietary rights of any third party.
• The organizer reserves its right to disqualify any entry if it’s not deemed suitable for the contest.
• The winner will also be contacted within two (2) weeks of the announcement by the organizer, i.e.: by February 15th. If the winner cannot be contacted or does not claim the prize within two (2) days of notification by DM (Direct Message on the Instagram profile), the Influencer reserves the right to withdraw the prize from the winner and pick a replacement winner.
• The contest and these terms and conditions will be governed by the laws of India and any disputes will be subject to the exclusive jurisdiction of the courts of Noida.
• Any personal data of the participants will be used as per the organizer’s privacy policy and following the applicable Data Privacy Laws at all times.
• Agreement to Terms and Conditions/Rules: By entering or participating in this content, each participant accepts and agrees to abide & be bound by this Terms and Conditions (T&C) and organizer’s decisions, which are fully and unconditionally binding in all respects. Mere participation should not be perceived as any commitment on the part of organiser to select a participant as the winner. Nothing herein amounts to a commitment by organiser to conduct further, similar or other contests in the future. The organizer reserves the right to refuse, withdraw, or disqualify any entry at any time at their sole discretion. By entering this campaign, the participant represents and warrants to be legally eligible to participate based on eligibility requirements explained in the above-mentioned rules and are of such legally permissible age.
• Territory: This campaign is only valid in the Territory of India.
